Summary of Case: |
"Andrew Adams was wrongly convicted in 1993 of a 1990 murder and sentenced to life in prison. In 1998 Adams submitted an application to the Criminal Case Review Commission (CCRC) for review of his conviction as a miscarriage of justice. Adams's case was referred by the CCRC on 9/27/2005 to the England and Wales Court of Appeal (Criminal Division). Adams' conviction quashed by the Court of Appeals on January 12, 2007 based on new evidence of ineffective assistance by his trial counsel for failing to discover and use three items of exculpatory evidence made available by the prosecution. His claim for compensation filed in 2007 was denied by the British government on the basis his conviction hadn't specifically been quashed on the basis of his innocence. In February 2009 the UK's Court of Appeal upheld the government's ruling in denying him compensation." |
