Summary
of Case:
|
"Wrongly convicted by a jury of sexually misconduct with an 8-year-old girl allegedly committed in the fall of 1999. The charges were based on the testimony of the alleged victim and her mother. B (whose full name was kept secret by law because the alleged victim was a minor) was acquitted of four counts, and convicted of two counts. On appeal the Queensland Court of Appeal ruled on February 16, 2001 that all the charges were based on similar facts, and the alleged victim's testimony wasn't reliable, and since there was insufficient evidence to support a conviction, they were quashed and the charges ordered dismissed without a retrial." |
