Legislature Overturned Conviction after Execution

Summary of Case:

"AP wire story on Jan 8, 2003. "A homeless man who killed himself in a police holding cell hours after he was charged with rape has been cleared of the crime through DNA evidence, police said. Forensic evidence collected after the alleged rape does not genetically match that of Wade Evan Deemer, who hanged himself with his shirt at the West Chester police station in August, investigators said Tuesday. "It's not his DNA," police Sgt. Thomas Yarnall said. "It appears that he did not do it." Deemer, 41, was arrested Aug. 24 [2002] after he was identified by an 18-year-old woman as the man who forced her into the woods near a convenience store and raped her. Police said the rape investigation is ongoing. Deemer was diagnosed with bipolar disorder about a year before his arrest and did not have his medication with him, his stepmother Connie Deemer said. "He was depressed and this trauma of the arrest was just too much for him to deal with," she said.""
