He was released in 1998 after three years imprisonment, and his conviction was overturned in 1999 after DNA tests identified another man as the perpetrator of the crime. On January 27, 2005, the Ontario Court of Appeal granted Gordon Folland the right to sue his trial lawyer for negligently defending him. Folland was represented by AIDWYC.
