Summary of Case: |
"Caferi Sad?k Gokce was co-defendant of R?za Demirel. Both men were wrongly convicted in December 2003 of "belonging to an illegal organisation." After being arrested in March 1995, Caferi Gokce and Demirel were indicted in April 1995 under Article 168 § 2 of the Criminal Code. They were held without bail until September 24, 1999. Four years later they were then convicted and taken into custody. Their conviction was quashed on appeal in February 2006. On June 22, 2006, the European Court of Human Rights ruled that the two men's complaints concerning the length of their detention on remand and the criminal proceedings against them were violations of Article 6 § 1. The Court awarded each applicant EUR 10,000 in respect of non-pecuniary damage and EUR 1,500, jointly, for costs and expenses." |
