Summary of Case:

"Wrongly convicted of criminal contempt in Gilpin County, CO by Judge Henry Nieto in Feb. 10, 1997 for failing to volunteer as a prospective juror during the voir dire of a drug related case that she was philosophically in disagreement with some of the drug laws. The judge ruled that by not volunteering the information, which was not sought by the state, the judge or the defense during voir dire of the May 1996 methamphetamine possession case, Kriho had "obstructed the process of selecting a fair and impartial jury." Kriho honestly answered every question asked of her, and her criminal contempt conviction was overturned by the Colorado Court of Appeals in April 1999. The Appeals Ct. ruled that Judge Nieto had improperly invaded the secrecy of the jury room by allowing testimony during Kriho's contempt trial from other jurors about the jury room deliberations that occurred during the meth case. The Appeals Ct. also ruled there was insufficient evidence to convict Kriho of criminal contempt, even if the testimony of the jurors hadn't been improper. The contempt conviction was dismissed on August 9, 2000."
