Summary of Case:

"Jalal Abodalo was wrongly convicted on August 24, 2009 of sexually abusing his nephew in December 1994 and again in September 1998 -- when the nephew was 5 and 9 -- in Nassau County, New York. After his conviction by a jury Abodalo was sentenced to 14 to 15 years in prison. Abodalo's convictions were affirmed on direct appeal in 2012. On June 3, 2014 Abodalo filed a post-conviction petition in which he argued for his actual innocence based on new evidence that he was outside the country at the time the two alleged incidents occurred. In December 1994 Abodalo was in Saudi Arabia and Germany -- but not in the U.S. Saudi Arabia is almost 6,500 miles from Nassau County, NY. In September 1998 Abodalo was in Syria -- but not in the U.S. Syria is 5,700 miles from Nassau County, NY. The evidentiary hearing related to Abodalo's petition was held by Judge Teresa K. Corrigan over 39 days from April 14, 2015 to May 2, 2016. On July 29, 2016 Judge Corrigan issued her ruling vacating Abodalo's conviciton of the two counts based on his actual innocence of the two counts because he had proved by clear and convincing evidence that he was not in the United States at the time the alleged crimes occurred. Judge Corrigan did not overturn Abodalo's convictions of seven other counts that allegedly occurred on different dates."
