"Abdiaziz Ali Adan was wrongly convicted of misdemeanor fourth-degree assault of a correctional employee on December 22, 2013 at Minnesota's Stillwater Correctional Facility. The charge was based on Adan, who was a prisoner, allegedly spitting on the employee. Adan's defense was that he was trying to spit on another prisoner who was near the officer. Adan was convicted by a jury and sentenced to 180 days in prison to be served consecutively with his current prison term. On November 9, 2015 the Minnesota Court of Appeals reversed Adan's conviction on the basis the prosecution introduced insufficient evidence to sustain his conviction, because there was no evidence proving the transfer of bodily fluids (spit) to the officer was intentional which is an essential element of the crime that must be proved."
