Summary of Case: |
"Zeng Aiyun was wrongly convicted in 2004 of murdering his classmate Zhou Yuheng at Xiangtan University, on October 27, 2003 in Xiangtan, China. Aiyun was sentenced to death. Aiyun and his codefendant and fellow classmate, Chen Huazhang, were arrested in November 2003. Huazhang was also convicted of murder, but was sentenced to life in prison. China's Supreme People''s Court overturned the convictions of both men and ordered their retrial. On July 21, 2015 the Xiangtan Intermediate People''s Court acquitted Aiyun after his fourth trial, on the basis their was insufficient evidence to prove his guilt beyond a reasonable doubt. After his acquittal he was immediately released after 11 years and 8 months in custody. The appeals court reconvicted Huazhang on the basis he deliberately laid a false trail and imputed the murder to Aiyun, who was in love with the victim''s ex-girlfriend. Huazhang was sentenced to life in prison and fined 178,143 yuan (US $29,108) as restitution to the victim''s family. It was reported on December 29, 2015 that Aiyun was awarded compensation of 1.27 million yuan (US$195,700) by Hunan province." |
