Summary of Case:

"Robert Aldrich Jr. was wrongly convicted on July 28, 2005 of larceny of a vehicle in Brookline, Massachusetts. Aldrich's prosecution was based on the testimony of officers who said he matched the description they heard over their radio of a man who witnesses saw leaving the scene of a stolen car. No eyewitnesses, physical, or forensic evidence linked Aldrich to the crime. Robert Aldrich declined a lawyer, and requested that the prosecution provide him with a transcript of the police radio transmissions. The prosecution did not provide the transcript prior to his trial, and the judge denied Aldrich's request to continue his trial. The officer testified that Aldrich matched the description of the thief who he said was described as wearing a blue jacket and blue pants. After his conviction by a jury Robert Aldrich was sentenced to 5 to 7-1/2 years in prison. While Aldrich was imprisoned the transcript was completed and provided to him. It showed that the officers description wasn't in the transcript and it contradicted the officers testimony. Aldrich filed a motion for a new trial based on the new exculpatory evidence. The motion was granted on August 30, 2006, and the Norfolk County DA's motion to dismiss the charges was granted on September 28, 2006. Aldrich filed a federal cvil rights lawsuit against the City of Brookline and the Brookline PD, that was dismissed. In 2008 Aldrich settled his state lawsuit against the State of Massachusetts for $60,000 in compensation under Massachusett's law G.L.C.258D."
