Summary of Case: |
"Jack Allan was wrongly convicted by a jury on August 24, 2012 of exposing himself to three minor girls in Aberdeen, Scotland in 2010 an 2011 based on his confession, that he retracted as coerced. Allan was sentenced to three years probation. Allan appealed, citing the trial judge's errors of not allowing hm to present evidence of what occurred during his interrogation, and expert evidence that he suffered from an identity disorder which doctors say left him suggestible and responsive to threats -- so he told the officer what they wanted to hear when his actual position was he was innocent of the offenses. During Allan's trial he testified, I apologise for lying to the police in the interview but I had to tell them what they wanted to hear; what they told me to say. On June 25, 2014 Scotland's Court of Appeals quashed Allan's convictions on the basis the trial court's rulings restricting Allan from presenting evidence in his defense made his convictions unsafe. Judge Lady Smith wrote in the appeals court's ruling, "We are satisfied that a miscarriage of justice has occurred and we will accordingly quash the conviction." |
