Summary of Case:

"Jose Arteaga was wrongly convicted in April 2016 of misdemeanor theft involving a motor vehicle in Orange County, California. A witness told police that the SUV's driver as a gang member named "Edgar." Arteaga's prosecution for felony vehicle theft was based on his identification by a Garden Grove police officer who selected him from a photographic lineup as the person he saw driving a stolen SUV that crashed after it left an apartment complex. DNA tests were performed on samples taken from various parts of the SUV, including the owner's manual that was found lying loosely in the vehicle. The DNA tests detected the DNA profiles of three individuals, but not Arteaga's DNA. Arteaga was unable to raise bail, and the DA offered a deal of his immediate release with time served and probation if he would pled guilty to misdemeanor theft. Arteaga took the deal and was released after 116 days in the Orange County Jail. The Orang County Crime Lab subsequently uploaded the DNA profiles to the FBI CODIS DNA database. It resulted in a hit for a gang member named "Edgar." Based on the new evidence Arteaga had been misidentified by the police officer, the Orange County District Attorney's Office reinvestigated Arteaga's case, and filed a motion to vacate his conviction and dismiss the charge, which was granted on September 13, 2016."
