Summary of Case:

"Edmund M. Autuori was wrongly convicted on March 12, 1998 of 16-counts of federal mail and wire fraud related to his job as an accountant for Arthur Andersen that was the accounting firm for Colonial Realty whose bankruptcy became a scandal. After Autuori's conviction and before he was sentenced, U.S. District Court Judge Ellen Bree Burns granted Autuori's motion for a judgment of acquittal. In Judge Burns' 86-page ruling dated August 28, 1998, she wrote that Autuori's convictions were a "manifest injustice" because the prosecution's conflicting and contradictory evidence was insufficient to prove his guilt beyond a reasonable doubt. It was only the second post-trial motion vacating a conviction that Judge Burns had granted in her 20 years as a federal judge. The US Attorney's Office appealed, and on May 12, 2000 the US Second Circuit Court of Appeals affirmed Autuori's acquittal of most counts, and granted a retrial on the others. The case was remanded to the district court and the prosecution elected not to retry him."
