Summary of Case:

"Clarence Bailey was wrongly convicted on March 16, 2009 of the second-degree attempted murder of a man in Brooklyn, New Yrok on the night of May 5, 2007. The prosecution's case was based on a single eyewintess who gave a suspect identification of Bailey, in admitting he was focused on the gun displayed and did "not fully" have a good opportunity to view the gunman. After Bailey's conviction by a jury he was sentenced to 20 years in prison. Bailey appealed arguing there was insufficient evidence to support his conviction. On January 9, 2013 the Appellate Division of the New York Supreme Court reversed Bailey's conviction as being against the weight of the evidence presented at trial and that his acquittal would not have been unreasonable."
