His conviction was based on a grainy surveillance video that while it showed Baker was in the bar, it doesn't show him throwing the glass. No eyewitness saw him throw the glass. Joshua Baker was sentenced to eight years in prison. On September 30, 2010, Ohio's 6th District Court of Appeals overturned Baker's conviction based on the insufficiency of the evidence."
