"Michael Barrie was wrongly convicted in 2007 of criminally negligent homicide in the death of the 20-year-old woman who a passenger on his motorcycle when he crashed in 2005 in Medford, Oregon. Michael Barrie was convicted after a bench trial, and the judge sentenced to 19 months in prison. Barrie appealed and he was allowed to remain free on bail. On April 15, 2009 the Oregon Court of Appeal overturned Barrie's conviction on the basis that Barrie was denied due process because he was charged with second-degree manslaughter, and the judge did not have the jurisdiction to find him guilty of the lesser charge of criminally negligent homicide."
