Summary of Case: |
"Julie Baumer was wrongly convicted in 2005 of first-degree child abuse for allegedly violently shaking her 6-week-old nephew, Philipp Baumer, in 2003, leaving him blind and brain injured. Julie Baumer was awarded a new trial in November 2009 based on ineffective assistance of counsel. She was released on bail pending her retrial. Based on new medical evidence suggesting the boy suffered from venous sinus thrombosis or a 'childhood stroke,' rather than being abused, a jury acquitted Baumer on October 16, 2010, after a retrial. She was wrongly imprisoned for more than 4 years. Her attorney for her retrial was Carl Marlinga, former prosecuting attorney for Macomb County." |
