"Bearden was wrongly convicted of culpable homicide for being the driver of a vehicle that was involved in a fatal car crash. In overturning his conviction in 1943 the New York Court of Appeal ruled the prosecution's circumstantial evidence didn't prove beyond a reasonable doubt Bearden was guilty of every essential element, and stated: "Consequently, the standard of proof in criminal cases resting on circumstantial evidence-proof excluding to a "moral certainty" every reasonable hypothesis except that of guilt-has not been met, and this defect raises a question of law reviewable in this court.""
