Summary of Case:

Derrick Bell was wrongly convicted in 1996 of robbery and assault based solely on the testimony of the victim. Bell was sentenced to 12-1/2 to 25 years in prison. In August 2007 the federal Second Circuit Court of Appeal overturned Bell's conviction on the basis of ineffective assistance of counsel. Bell's lawyer had failed to present expert testimony that the victim was so traumatized from his injuries and blood loss that he could not reasonably have been expected to have clearly seen his assailant.
