Summary of Case:

"Michael Bonaccorso was wrongly convicted on February 22, 2018 of two counts of Driving While Intoxicated in Monroe County, New York. After his conviction in the East Rochester Town Court (Monachino, J.), Bonaccorso appealed. On May 3, 2019 the Monroe County Court reversed Bonaccorso's convictions and ordered the charges dismissed. In his ruling Judge Christopher S. Ciaccio stated the arresting officer did not have probable cause to stop Bonaccorso, so all evidence elicited as a result of that stop was inadmissible and the trial judge erred by denying suppression of that evidence. Judge Ciaccio also ruled that Bonaccorso's waiver of a jury trial was invalid. The ruling stated: "... the appeal is GRANTED, the decision and judgment of the East Rochester Town Court is REVERSED, and the action dismissed."
