Summary of Case:

"Cesar N. Boncan was wrongly convicted in 2012 of defrauding Home Bankers Savings & Trust Co. (now Citibank Savings, Inc.) in the Philippines. Boncan was a cash officer at the bank. Boncan and two superiors at the bank were prosecuted for their alleged involvement in an elaborate scheme involving the depositing of unfunded checks and hastily encashing the amount within the same day. All three were convicted. On March 21, 2016 the Court of Appeals, Fourteenth Division, reversed Boncan's conviction, ruling that the prosecution failed to introduce evidence proving Boncan intended to participate in the conspiracy because it was his superiors who had the authority to check the sufficiency of the drawer’s funds. In contrast, the appellate court said it was “immediately apparent” that Boncan's codefendants -- Jose M. dela Cruz and Ricardo M. Angeles -- assistant manager of the accounting department and operations officer of the main office, respectively -- were guilty of the crime."
