Summary of Case: |
"Yeidja Bostick was wrongly convicted on June 27, 1990 of vehicular homicide, aggravated assault, five counts of recklessly endangering another person and three counts of simple assault, related to an auto accident on August 18, 1989 in Philadelphia, Pennsylvania caused by a stolen Volvo being pursued by the police that ran a red light. Bostick's prosecution was based on the theory she was the driver, and her conviction was based on the testimony of three experts that Bostick was the driver. Bostick presented witnesses and her own experts that she was a passenger. Bostick was allowed to remain free on bond until February 1991 when she was sentenced to 5 to 10 years in prison. Bostick's convictions were affirmed in February 1992 by the Pennsylvania Superior Court. A month later, in March 1992, Bostick filed a post-conviction petition based on the new evidence of five eyewitnesses that she was a passenger in the car. After holding an evidentiary hearing, in April 1993 Philadelphia County Commons Pleas Court Judge John Poserina, Jr. vacated Bosticks convictions, ordered a new trial, and she was released on bond pending her new trial. On December 23, 1993 Bostick was acquitted of all charges after a bench (judge only) retrial." |
