Summary of Case:

"Simon Bouie was wrongly convicted on March 25, 1960 of resisting arrest in Columbia, South Carolina on March 14, 1960 when he was arrested for trespassing and resisting arrest when he and a friend refused to leave a restaurant where they were sitting in a booth. On February 13, 1962 the South Carolina Supreme Court reversed Bouie's resisting arrest conviction on the basis there was insufficient evidence he committed the crime. Bouie had at the same time been convicted of criminal trespass, along with his friend Talmadge J. Neal. The South Carolina Supreme Court affirmed their criminal trespass convictions and they appealed to the U.S. Supreme Court. On June 22, 1964.the U.S. Supreme Court reversed Bouie and Neals' trespassing convictions on the basis their conduct was not enumerated as a crime at the time of their arrests, so "they have been deprived of liberty and property without due process of law in contravention of the Fourteenth Amendment.""
