Summary of Case:

"William Bowles was wrongly convicted of reckless driving on December 8, 1947 related to a head-on traffic collision on July 21, 1940 in Steuben County, New York in which a woman was killed. Bowles conviction was basedon the testimony of a passenger in the other vehicle. Bowles testified in his defense. After the jury convicted Bowles he was sentenced to one month in jail and a fine of $100. Bowles appealed, and on July 9, 1952 the New York Supreme Court Appellate Division reversed his conviction on the basis the prosecution introduced insufficient evidence of his guilt, and ordered dismissal of his indictment. The Court's opinion stated: "It is our opinion that the evidence in this case is insufficient to warrant a finding beyond a reasonable doubt that the defendant on the occasion in question operated his motor vehicle in "disregard of the consequences which may ensue from the act, and indifference to the rights of others.""
