Summary of Case:	"David Wayne Boyce was wrongly convicted in 1991 of capital murder and robbery in the 1990 death of his roommate, 35-year-old Timothy Kurt Askew, at a Newport News, Virginia motel. David Boyce was sentenced to life in prison. Boyce's conviction was vacated in March 2013 by a federal judge who ruled key evidence was withheld from Boyce's trial lawyer and that false testimony was presented by the prosecution. In September 2013 the Commonwealth Attorney's Office announced Boyce would not be retried and the charges would be dismissed because there was insufficient evidence to convict the now 42-year-old Boyce."
