Summary of Case:

"Ted Louis Bradford was wrongly convicted in 1996 of first-degree rape and first-degree burglary in the 1995 rape of a 25-year-old woman in Yakima, Washington. Arrested for indecent exposure six months after the attack in the area the rape had occurred, Ted Bradford was intensively interrogated for eight hours before admitting to some details fo the crime. Immediately afterwards, Bradford retracted his statements and said he only told the detectives what they wanted to hear because he was tired and hungry. Bradford was sentenced to 10 years in prison and was released in 2005 after completing his sentence. In 1996 the woman obtained a $600,000 civil judgment against Bradford. The DNA testing of biological material collected in 2004 that was on the adhesive side of duct tape used to cover the eyeholes of the mask the woman was forced to wear excluded Bradford as the rapist. On September 13, 2006, a Yakima County Superior Court judge vacated Bradford's conviction based on the new evidence of a DNA test unavailable at the time of his conviction. The Washington Court of Appeals reinstated Bradford's conviction. Bradford was acquitted on February 11, 2010, after a retrial. Bradford was wrongly imprisoned for 10 years. The status of the erroneous $600,000 civil judgment needs to be litigated. On February 7, 2013 filed a federal civil rights lawsuit that named Yakima Detective Joseph Scherschligt as the defendant. The U.S. district court judge granted Scherschligt's summary judgment motion on the basis Bradford didn't file it before expiration of the three year statute of limitations under 42 U.S.C. §1983. Bradford appealed. In September 2015 the U.S. Ninth Circuit Court of Appeal reversed the ruling on the basis the three year statute of limitations didn't begin until his acquittal -- so he filed the lawsuit with three days to spare."
