Summary of Case:

"Quincy Devon Brooks was wrongly convicted on July 3, 2017 of possession of cocaine in an amount of less than one gram in Galveston County, Texas. Quincy Brooks pled guilty in the Galveston County 56th District Court case no. 17CR1879-83-1, and he was sentenced to six months in state jail. Laboratory analysis of the substance in Brooks' possession revealed that it was not cocaine or any other concealed substance. Brooks filed a writ of habeas corpus to withdraw his guilty plea based on the new evidence. The Galveston County DA's Office did not oppose Brooks' petition and the District Court judge recommended it be granted. Brooks was granted bond and released on a personal recognizance bond on August 22, 2017. On October 4, 2017 the Texas Court of Criminal Appeals agreed with the District Court and granted Brooks' writ of habeas corpus on the basis his guilty plea was involuntary because of the newly discovered laboratory analysis that he did not possess any cocaine or any other controlled substance. However, the Court ruled that Brooks was not actually innocent of the offense. The motion to dismiss the case filed by the Galveston County District Attorney's Office was granted on December 7, 2017."
