Summary of Case:	"Gary Lee Burdick was wrongly convicted of the November 29, 1975 robbery of a gas station in Rochester, New York where he worked, although the attendant on duty who knew him did not identify him as the robber. Burdick's conviction was solely based on circumstantial evidence that his teeth were similar to the robbers teeth described by the attendant. On February 28, 1979 the New York Supreme Court Appellate Division vacated Burdick's conviction on the basis the prosecution's circumstantial evidence was insufficient to prove his guilt, and ordered dismissal of his indictment."
