"Calvin Burdine was wrongly convicted of murder in 1983 in Texas and sentenced to death. Burdine's conviction was reversed in August 2001 by the 5th Circuit en banc on grounds his lawyer's dozing during his trial constituted ineffective assistance of counsel violative of his 6th Amendment right to counsel, because "sleeping counsel is equivalent to no counsel at all." Burdine's case came to a legal end when the Supreme Court declined on June 3, 2002 to accept the State of Texas' appeal of the 5th Circuit's ruling."
