"George Burnham Jr. was wrongly convicted in January 1907 of grand larceny in New York City. George Burnham was the ex-Vice President and general counsel of the Mutual Reserve Life Insurance Company. He was prosecuted on the charge of grand larceny for allegedly being a party to the settlement of a suit against ex-President Frederick A. Burnham of the Mutual Reserve, out of the company's funds. Burnham was sentenced to serve two years in prison. On May 31, 1907 Burnham's conviction was set aside on appeal on the basis the prosecution failed to establish he had the requisite criminal intent. Burnham was released after 4-1-2 months of wrongful incarceration."
