Summary of Case:

"Pierre Cabell was wrongly convicted in July 2012 of coercion in Akron, Ohio. Cabell was convicted as part of a scheme by a friend to demand $500 ransom for a lost dog. Cabell was apprehended when he showed up to collect the money. At the close of the prosecution's case Cabell made a motion for a judgment of acquittal on the ground the prosecution had failed to introduce evidence Cabell made any threat against the dog's owner. The judge denied the motion. After Cabell was convicted by a jury the judge sentenced him to six months probation, but stayed the sentence pending the outcome of his appeal. Cabell appealed on the basis there was insufficient evidence he threatened the dog's owner as required by the Ohio's coercion statute. On November 20, 2013 the 9th District Court of Appeals vacated Pierre's conviction on the basis the prosecution failed to introduce evidence proving he committed coercion, because he did nothing to coerce the dog's owner to pay the money. The Court also ruled that Cabell couldn't be found guilty on the basis of "complicity" as the State argued on appeal, because the prosecution didn't request a complicity jury instruction and the judge didn't give one to the jury."
