Summary of Case:

"Leslie Lyle Camick was convicted in U.S. District Court in Wichita, Kansas on January 31, 2014 of seven counts that included mail fraud, wire fraud, providing false statements to the U.S. Patent Office, obstruction of justice (intimidating a federal witness), and three counts of aggravated identity theft. Camick, a Canadian citizen, entered the United States in July 2000 using the identity of his deceased brother, Wayne Bradly Camick. He adopted his brother’s identity to avoid paying back taxes and child support in Canada and to evade the legal consequence of the permanent revocation of his Canadian driver’s license due to numerous driving-while-intoxicated offenses. Camick was indicted by a federal grand jury on March 26, 2013, although a superceding indictment was later filed. After his conviction by a jury that deliberated for an hour, On February 13, 2014 Camick filed a motion for a judgment of acquittal that was denied by the trial judge on April 7, 2014. On April 21, 2014 the judge sentenced the 58-year-old Camick to a total of 4 years in prison, and to pay restitution of $15,186 to a former "girlfriend" who invested in one of Camick's business ventures. Camick appealed. On July 31, 2015 the U.S. Tenth Circuit Court of Appeals by a 2 to 1 vote, vacated all of Camick's convictions except for his obstruction of justice conviction that was for his conduct in filing a federal lawsuit unrelated to his other convictions. The Court ruled that the prosecution introduced insufficient evidence to prove materiality of the evidence relied on to support his vacated convictions. The Court also reduced the restitution related to the obstruction of justice count by $8,520.50, to an award of $6,665.50. The dissenter argued that all of Camick's convictions should have been vacated because the government introduced insufficient evidence to support his obstruction conviction. The government's motion for a rehearing was denied, and on September 1, 2015 the mandate was issued to the U.S. District Court to execute the appeal court's ruling. Camick was arrested on March 28, 2013 and released on $5,000 bond on June 3, 2013 pending his trial. "
