Summary of Case: |
"DeMarchoe Montez Carpenter (aka Demarco Carpenter) and Malcolm Scott (aka Malcom Scott) were wrongly convicted on November 9, 1995 of first-degree murder, attempted murder, and other charges related to the 1994 shooting death of 19-year-old Karen Summers in Tulsa, Oklahoma. Scott and Carpenter were 18 when each was sentenced to life imprisonment plus 170 years. A post-conviction investigatio of their case by the Oklahoma Innocence Project discovered the new evidence of sworn statements from three men who claim to be the actual perpetrators of the drive-by shooting, as well as signed affidavits from eyewitnesses recanting what they testified at Scott and Carpenters trial. On May 9, 2016 Tulsa County District Judge Sharon Holmes granted their applications for post-conviction relief on Monday and declared them actually innocent based on new evidence that was not presented to the jury that found them guilty in 1995. Prosecutors said they intend to appeal the decision. Scott and Carpenter were ordered immediately released on bond, and they were released from custody on May 10, 2016. On November 10, 2016 the Oklahoma Court of Appeals denied the State's appeal." |
