Summary of Case:

"Quentin Carter was wrongly convicted in 1992 of sexually assaulting a 10-year-old girl on Sept. 2, 1991 in Kent County, Michigan. Carter's conviction was based on the testimony of the victim. After his conviction by a jury he was sentenced to 6 to 20 years in prison. After Carter's conviction the victim twice went to authorties and reported that her rapist was actually her mother's then boyfriend -- Aurelias Marshall -- and that her mother witnessed the assault. Carter was released on parole in 2008 after serving 17 years of his sentence. In 2014 the woman was interviewed during a cold case investigation of the 1990 murder of Joel Battaglia, and she told the investigators that Carter was innocent of raping her. The Kent County DA's Office initiated an investigation of Carter's case. The Kent County Prosecutor's Office publicly revealed in early June 2015 that their reinvestigation of Carter's case established that he was actually innocent. The DA's Office wrote a motion to set-aside Carter's conviction that he filed. On June 25, 2015 Carter's motion to set-aside his conviction was granted by Kent County Circuit Court George Buth, who wrote in his order, "The perjured testimony presented as a result of the actions of Aurelias Marshall created an irregularity so offensive to the maintenance of a sound judicial process that the Feb. 26, 1992, conviction of first-degree criminal sexual conduct cannot be allowed to stand." On June 8, 2015 Marshall was found guilty by a jury of murdering Battaglia."
