Summary of Case:

"Mak Chai-kwong and Tsang King-man were wrongly convicted in June 2013 of fraud for allegedly cross-leasing their flats in Hong Kong in order to siphon off HK$570,000 in government accommodation allowances between 1985 and 1990. Chai-kwong, former secretary for development of the Highways Department, and King-man, former assistant director of Highways Department, were charged with conspiracy to defraud the government in abusing the Private Tenancy Allowance, a benefit for civil servants to claim for rents paid for private flats. After their conviction in the Hong Kong District Court the two defendants were sentenced to 8 months in jail, suspended for two years by Judge Johnny Chan Jong-herng. The Court of Appeals affirmed the convictions. On January 6, 2016 Hong Kong's Court of Final Appeal overturned the conviction, questioning the premise for the prosecution's case, and determining there was no clear evidence to support they had committed their convicted crimes."
