Summary of Case:

"Ryan Francis Chase was wrongly convicted in 2012 of animal cruelty in Bell County, Texas. Chase's prosecution was based on an incident on September 2, 2009 while he and his wife were walking a puppy and their grown dog Maka. Two pit bulls attacked Maka, and Chase and a neighbor were able to get one of the pit bulls, Zeus, off his dog after it had its jaws clamped on Maka's neck. Chase returned with a rope and he was able to wrap it around Zeus' neck. He draged Zeus to his house and slit its throat. Chase was prosecuted for animal cruelty, and the judge denied his motion to present the affirmative defense under Texas law that allows a person to kill a dog or coyote that is “attacking or about to attack or has recently attacked livestock, domestic animals, which includes dogs.” After his conviction forllow a bench trial, Chase was sentenced to one year in jail, suspended to one year probation conditioned on good behavior, and a find of $500. Chase appealed. On November 26, 2013 the Texas Court of Criminal Appeals reversed Chase's conviction on the basis the trial judge erred by denying his affirmative defense under Texas law that he could kill a killer pit bull that was known to have attacked a domestic dog."
