"Kum Yet Cheung was twice wrongly convicted of attempting to murder two men outside a Denny's restaurant in Emeryville, California. First conviction in 1996, second in 1999. The California Court of Appeals vacated Cheung's conviction in 2002 based on a long list of errors, including prosecution witness perjury, prosecutorial misconduct of withholding exculpatory medical records evidence, eyewitness error and ineffective assistance of counsel in failing to get a taped confession by the actual shooter translated from Cantonese or introduced as evidence." |
