Summary of Case:	"Harold W. Cogdell was an attorney wrongly convicted on May 24, 2006 of direct contempt of court in Cabarrus County, North Carolina. On May 15, 2006 Cogdell was representing a client during a criminal trial when in the presence of the jury he asked a detective testifying for the prosecution during cross-examination, if a confidential informant providing evidence against Cogdell's client had been "polygraphed about his statement?" The trial judge admonished Cogdell that he knew polygraph evidence was inadmissible, and instructed the jury to disregard Cogdell's question. After the trial was over the judge held a hearing during which he found Cogdell guilty of direct contempt of court and he was fined $500. Cogdell appealed. On May 15, 2007 the North Carolina Court of Appealed unanimously reversed Cogdell's conviction on the basis the trial judge's finding of guilt was fatally defective as a matter of law because he had failed to find Cogdell guilty "beyond a reasonable doubt.""
