Summary of Case:

"Anthony Costanzo was wrongly convicted of evidence tampering for sending a video to the lawyer of a defendant in a case in 2012. At the time Costanzo was a detective at the Broward Sheriff’s Office, and after emailing a video of a police officer's statement in a criminal case that he recorded on his phone to the general counsel for the Police Benevolent Association, he deleted the video from his phone. After the prosecution presented its case the trial judge denied a motion by Costanzo's lawyer for a judgement of acquittal based on insufficient evidence of his guilt. Costanzo was convicted by a jury. On December 3, 2014 Florida's Fourth District Court of Appeal reversed Costanzo's conviction on the basis he never tried to tamper or destroy evidence. The Court noted that he did the opposite in stating, "As we know from videos that have gone viral, texting or e-mailing a video is the antithesis of trying to destroy it." On February 9, 2015 a Broward County judge dismissed the charge against Anthony Costanzo."
