Summary of Case: |
"Justin Patrick Crotty was wrongly convicted in May 2015 of assaulting his wife Camilla on August 9, 2014 at their apartment in Sydney, Australia. The charges were filed after Camilla Crotty called her friend, Sally Obermeder who she had a late lunch with that day, at about 9:30 pm and told her that her husband was angry and had hit her when she arrived home at 8:30, because he had to leave the next morning at 6 am for a business trip to South Korea. During Cotty's bench trial his wife gave conflicting accounts about what happened, exaggerated her injuries, and she admitted she drank a quantity of alcohol before she arrived home. Obermeder, a Sydney television personality, testified about the alcohol Camilla drank at lunch and the phone call that evening. Crotty denied hitting his wife, who had no visible injuries, so his trial was "he said, she said." After his conviction in the Downing Centre Local Court, Justin Crotty was sentenced to an 18 month suspended jail sentence and fined AUS$1,000. Crotty appealed. In January 2016 New South Wales District Court Judge Garry Neilson overturned Crotty's conviction based inconsistencies in his wife's (the complainant) testimony that only made her account "plausible", and it was not sufficient to prove beyond a reasonable doubt that Crotty assaulted her as she claimed." |
