Summary of Case:

"Roberto Cuevas was wrongly convicted in December 2003 of the May 14, 2003 robbery of a Los Angeles Rite Aid Pharmacy store. The prosecution's case was based on identification of Cuevas from the store's surveillance video. After his conviction by a jury he was sentenced to 12 years in prison. Cuevas filed a post-conviction petition for a new trial based on new surveillance videotape evidence that he was not the robber. New technology not available at the time of Cuevas' trial was able to enhance the video to show he wasn't one of the robbers. On September 5, 2008 the Los Angeles County DA's Office conceded Cuevas was actually innocent and its motion to dismiss the charges was granted. Cuevas was released after 4 years and 8 months in custody. On December 1, 2008 Cuevas received an order of factual innocence pursuant to California Penal Code section 851.8(c). Cuevas filed a compensation claim with the State of California Victim's Compensation Board, which was granted on January 14, 2011 in the amount of $162,700 based on his 1,627 days in custody after his conviction."
