Summary of Case:

"James S. Doran was wrongly convicted in 2015 in federal court of embezzelment of $650,000 in federal funds. James Doran was a professor in the College of Business at Florida State University. He was a director, officer, and he had signatory authority over the Student Investment Fund (SIF) that was established by FSU for charitable and educational purposes. Doran allegedly transferred more than $650,000 from the SIF to his personal account, however, he returned the money after an audit. His federal prosecution was based on the allegation the SIF money was from grants by the federal government. After the prosecution presented its case, Doran made a motion for a judgment of acquittal based on the prosecution's failure to prove the money in the SIF was from the federal government. The judge denied Doran's motion. After his conviction by a jury, he was sentenced to 13 months in federal prison. On April 26, 2017 the U.S. Court of Appeals for the Eleventh Circuit reversed James Doran's conviction on the basis the trial judge erred in denying his motion for a judgment of acquittal because the prosecution failed to introduce sufficient evidence to prove the essential element that the alleged embezzeled funds were from the federal government."
