"Jean G. Dorvil was wrongly convicted of assault and battery in Brockton, Massachusetts for spankng his almost 3-year-old in public on May 13, 2011. On May 1, 2014 the Massachusetts Appeals Court affirmed Dorvil's convictions. Dorvil appealed and the Massachusetts Supreme Judicial Court accepted review of the appeals courts ruling. On June 25, 2015 the Massachusetts Supreme Judicial Court affirmed the right of a parent to spank his or her child in reversing Dorvil's conviction on the basis the prosecution introduced insufficient evidence to prove that Dorvil's disciplining of his child caused "severe emotional distress, “gross degradation” or physical harm “beyond fleeting pain or minor, transient marks.”"
