"DuPlessis was wrongly convicted of violating Section 118(1)(b) of the South African Defence Act (Act 44 of 1957), that prohibits the disclosure of any "statement, comment or rumour" relating to a member or activity of the South African Defence Force or the forces of a foreign country calculated to "prejudice or embarrass the Government in its foreign relations or to alarm or depress members of the public". DuPlessis' conviction was quashed because no document had been published, and so no crime could have been committed."
