"Margaret Earle was wrongly convicted in 2005 of second-degree murder in the 1985 death of her 21-month old daughter after her boyfriend stomped on the girl's stomach. Prosecutors successfully argued to the jury that Earle failed to seek appropriate medical attention for her daughter, Rachelle Pelletier. Earle's boyfriend was convicted of first-degree murder. On November 18, 2010, the Massachusetts Supreme Judicial Court overturned Earle's conviction on the basis the evidence of malice was "legally insufficient" to support her second-degree murder conviction. She cannot be retried."
