Summary of Case:	"Cassie E. Earley was wrongly convicted in 2013 of aggravated driving while intoxicated, reckless driving, and the traffic infraction of failure to keep right, all related to the death of a person her car collided with in Washington County, New York. The trial judge denied Earley's motion to suppress the blood test that was the basis of the State's case she was intoxicated at the time of the collision. After the jury convicted her she was sentenced to one year in prison for her aggravated driving while intoxicated conviction and fined for her reckless driving and failure to keep right convictions. Earley appealed. On October 16, 2014 the Appellate Division of the Supreme Court of New York, Third Department vacated Earley's aggravated driving while intoxicated conviction on the basis the test of her blood should have been suppressed because the Court that ordered the test wasn't informed that the State's application for the test was based on hearsay. Earley's non-alcohol related convictions were affirmed."
