Summary of Case:

"Nathaniel Edward Ellis was wrongly convicted on March 11, 1982 of aggravated assault for his participation in a fight that occurred in June 1981 in Franklin County, Ohio. Ellis' defense was he acted in self-defense. After he was convicted by a jury he was awarded a new trial by the Ohio Court of Appeals. Ellis was acquitted by a jury after a retrial based on his claim of self-defense. Ellis' compensation claim was denied by the Ohio Court of Claims on the basis he had been found not guilty based on self-defense and he had not proven his innocence by a preponderance of the evidence as required by Ohio's wrongful imprisonment compensation statute. Ellis' appeal was joined with that of Linda Lee Walden, whose claim had been denied on the same grounds. The Ohio Court of Appeals affirmed the Court of Claims' ruling. In 1989 the Ohio Supreme Court ruled that an acquittal based on self-defense qualified a person to file a claim for compensation under Ohio's compensation statute. However, the Court ruled that "in a proceeding under R.C. 2305.02, the claimant bears the burden of proving his innocence by a preponderance of the evidence." There is no record that Walden was awarded any compensation after the Ohio Supreme Court's ruling. Ellis pursued his claim after the supreme court's ruling, and on February 11, 1993 the Court of Claims denied his claim for $3,403,000."
