Summary of Case:

"John Elphinstone, 2nd Lord Balmerino was a Scottish aristocrat, convicted in a celebrated trial of the 1630s which became a crux of the religious issue of the time. In June 1634 Elphinstone was indicted for dangerous and seditious libel and confined for opposing the imposition of apparel upon churchmen in Scotland. He was confined at Edinburgh Castle. Although public opinion was on his side, he was convicted in March 1635 by a majority jury vote of eight to seven. He was sentenced to death. Before his sentence was carried out Elphinstone was granted a Royal Pardon in 1635 by Charles I, King of Scotland."
