"The 47-year-old German software engineer purchased a GPS system on the EBay internet auction service in 2005 for less than one third of its retail list price. Police monitoring Ebay sales determined the GPS unit was stolen, and charged the engineer with purchasing stolen merchandise. Convicted by the court's reliance on the prosecution's argument that he should have known it was stolen because of the low price he paid, the engineer was fined 1200 euros ($1700). He appealed. In September 2007 the appeals court overturned his conviction, ruling their was not sufficient evidence to support that he knew the device was stolen. "
