Summary of Case:

"Denis Field was codefendant of David Parse, and they were both wrongly convicted in 2011 of federal Mail Fraud and Corrupt Endeavor to Obstruct or Impede the Administration of the Internal Revenue Laws. Field was the former Chief Executive Officer of BDO Seidman, and he was one of seven people indicted in June 2009 for selling $7 billion in phony tax shelters to 931 wealthy people from 1994 to 2004. In June 2012 US District Court Judge William Pauley granted the pre-sentencing motions for a new trial by Field and two co-defendants, Donna Guerin and Paul Daugerdas on the basis a juror had lied about her background to make her appear “more marketable” as a juror. Pauley denied a new trial for Parse. Field was acquitted on October 31, 2013 after his retrial. Daugerdas was convicted after that retrial of seven counts, including tax evasion and conspiracy. He was sentenced to 15 years in prison. Guerin pled guilty and was sentenced to 8 years in prison. The conviction of Field's codefendant David Parse was reversed on appeal due to the judge erroneously denying his pre-sentence motion for a new trial based on the juror misconduct. The U.S. Attorney's Office declined to retry him, instead agreeing to one year of deferred prosecution. Parse's indictment was dismissed on November 23, 2016."
